1. About Liv's Creative Escapes
Liv's Creative Escapes ("Company," "we," "us," or "our") is a mobile paint-and-sip and creative event business offering public events, private parties, workshops, fundraising events, DIY projects, take-home kits, and related creative experiences.
Our services are designed to provide participants with a fun, social, and creative environment. No prior artistic experience is required unless otherwise stated.
2. Eligibility
By using our services, you represent that:
You are at least 18 years of age or have permission from a parent or legal guardian where applicable.
You have the legal capacity to enter into these Terms.
You will provide accurate and complete information when registering for events or making purchases.
Certain events may have additional age restrictions, which will be disclosed in the event description.
3. User Responsibilities and Acceptable Use
When participating in our events or using our website, you agree to:
Treat instructors, staff, venue personnel, and other participants respectfully.
Follow all event instructions and safety guidelines.
Comply with any rules established by the event venue.
Refrain from disruptive, abusive, threatening, discriminatory, or unlawful behavior.
Refrain from damaging Company property, venue property, or the property of others.
We reserve the right to refuse service, remove participants from an event, or cancel registrations without refund if a participant engages in inappropriate, unsafe, or disruptive conduct.
4. Payments, Refunds, and Cancellations
All prices are listed in U.S. dollars unless otherwise stated.
Payment is required at the time of registration or purchase.
Refunds, credits, cancellations, and ticket transfer policies are governed by our Refund Policy, which is incorporated into these Terms by reference.
Please review our Refund Policy before purchasing tickets or registering for events.
5. Event Changes
Liv's Creative Escapes reserves the right to:
Modify event locations, instructors, projects, or schedules when necessary.
Cancel or reschedule events due to weather, low attendance, venue issues, emergencies, or circumstances beyond our control.
Substitute comparable materials, supplies, or project elements when necessary.
Participants will be notified of significant changes using the contact information provided during registration.
6. Assumption of Risk
Participation in creative activities involves certain inherent risks, including but not limited to the use of paints, stains, adhesives, tools, and other craft materials.
By participating in any Liv's Creative Escapes event, you voluntarily assume all risks associated with participation and agree to take reasonable precautions to protect yourself and your belongings.
7. Limitation of Liability
To the fullest extent permitted by law, Liv's Creative Escapes, its owners, employees, instructors, contractors, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to:
Participation in events or activities;
Use of our website or services;
Personal injury, illness, allergic reactions, or property damage;
Lost, stolen, or damaged personal belongings;
Event cancellations, delays, or schedule changes.
Our total liability for any claim arising under these Terms shall not exceed the amount paid by the participant for the applicable service or event.
8. Intellectual Property
All website content, logos, branding, graphics, event descriptions, photographs, instructional materials, project designs, and other content created by Liv's Creative Escapes are the property of Liv's Creative Escapes or its licensors and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, sell, publish, or create derivative works from our content without prior written permission.
Completed artwork created by participants during events belongs to the participant; however, instructional materials, templates, stencils, project designs, and class content remain the property of Liv's Creative Escapes unless otherwise stated.
9. Photography and Marketing
Liv's Creative Escapes may photograph or record events for promotional, educational, or marketing purposes.
By attending an event, you grant Liv's Creative Escapes permission to use photographs or video footage that may include your likeness in marketing materials, social media, advertisements, and other promotional content without compensation.
If you do not wish to be photographed, please notify event staff before the event begins.
10. Third-Party Venues and Services
Many events are hosted at third-party venues. Liv's Creative Escapes is not responsible for the actions, policies, products, services, food, beverages, or facilities provided by third-party venues.
Participants are responsible for complying with all venue rules and policies.
11. Website Availability
We strive to maintain uninterrupted access to our website but do not guarantee that the website will be available at all times. We reserve the right to modify, suspend, or discontinue any portion of the website or services without notice.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms, our services, or participation in our events shall be subject to the exclusive jurisdiction of the state and federal courts located in Kansas.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will become effective upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
